Under California law, Saratoga is subject to the Builder's Remedy while awaiting State approval of the Housing Element and cannot deny approval of qualifying housing developments because they are inconsistent with the City's General Plan (lot sizes and housing type) or zoning regulations (allowed uses, height, and setbacks). Qualifying projects must have specific percentages of housing at certain affordability levels.
