Builder's Remedy Projects

Under California law, Saratoga is subject to the Builder's Remedy while awaiting State approval of the Housing Element and cannot deny approval of qualifying housing developments because they are inconsistent with the City's General Plan (lot sizes and housing type) or zoning regulations (allowed uses, height, and setbacks). Qualifying projects must have specific percentages of housing at certain affordability levels. As of September 28, 2023, the City has received three Builder's Remedy Project applications that may result in the addition of roughly 294 new housing units. These projects are listed below. The information provided is based on preliminary applications. Specifics, such as proposed architecture and site layouts, will not become final until final applications are submitted, likely in early 2024.


Chester Allendale

An 11.57-acre site located at the intersection of Allendale Drive and Chester Avenue.

  • 199 condominiums within 32 residential buildings; 40 units available to low-income households.

A 74.45-acre parcel located on Pierce Road adjacent to the Mountain Winery. 

  • 21 single-family homes, four units available for low-income households.

  • 74 three-story condominiums within 16 residential buildings; 15 units available for low-income households.
